While all is not settled in the soon-to-be smoke-free Sunshine State, it seems that Florida's tobacco leaf brokers and 27 cigar manufacturers will be exempt from the antismoking legislation approved by Florida voters last November.

Florida's House of Representatives and Senate have yet to agree upon the antismoking bill's final regulations, which are supposed to be in place by July 1, but both have similar intentions regarding the state's tobacco industries. In late April, both chambers expanded the definition of an exemption that would allow smoking in retail tobacco shops to include other tobacco businesses, such as cigar manufacturers, importers and distributors.

The Senate's amendment states that smoking would be permitted at "any enclosed indoor workplace of a business that manufacturers, imports or distributes tobacco products."

Before the amendment, Florida's cigar executives feared that the smoking ban would forever change the way they conduct business, keeping them from lighting cigars in their buildings, conference rooms, even their own personal offices. In January, nine Florida-based cigar companies sued the state to block the law. The lawsuit claimed that the ban would interfere in their legal businesses, violating the supremacy and commerce clauses of the U.S. Constitution.

The lawsuit has been placed on hold by the plaintiffs, who are awaiting the final regulations to be resolved by the legislature.

Now, according to Norm Sharp, president of the Cigar Association of America Inc., "The Senate and the House have identical language addressing the concerns of the cigar industry [in their respective amendments.]"

Florida's antismoking measure is known as the Florida Clean Indoor Air Act. In addition to tobacco shops, smoking will also be permitted at private residences (so long as they are not used for commercial healthcare), stand-alone bars and hotel rooms designated as smoking rooms.

The rewritten tobacco shop exemption has placated the cigar industry only in the short term.

"We're worried about our existence in the state," said Christian Eiroa, president of Caribe Imported Cigars, importers of Camacho, Baccarat and La Fontana cigars. "We're not happy about the smoking ban, but we're happy with the amendment to the exemptions. The alternative would have meant moving out of state to keep the company going."

The Senate and the House are in special sessions through May 27, and the antismoking bill is on the docket. However, the bill has been largely overlooked of late because priority has been given to economic issues. Other nuances concerning the antismoking measure have caused small feuds between the chambers, such as how the law will be enforced and the penalties for violations.

The lack of action concerns the cigar manufacturing community in Florida.

"The government hasn't done a thing," said Stanford Newman, the patriarch of J.C. Newman Cigar Co. "We don't know what's going to happen, only that the Senate and the House are supposed to put out the final regulations on July 1. That's all anyone knows."

The plaintiffs named in the lawsuit that was filed with the U.S. District Court in Tampa are: Altadis U.S.A Inc., Swisher International Inc., J.C. Newman Cigar Co., Caribe Imported Cigars, Central America Tobacco Corp. (Toraño Cigars), Puros Indios Cigars Inc., Oliva Tobacco Co., A.S.P. Enterprises Inc. and El Credito Cigar Co. Though a 30-day stay had been added on to a previous stay on May 5, there is uncertainty as to what will happen on June 5, when that last stay ends.

Sharp said, "The steps that need to be taken include either discontinuing the lawsuit altogether, moving forward with the lawsuit, or asking the federal court to rule on the constitutionality of the final legislation."
